These Terms of Service govern your use of Durex.media ("the Service"). By creating an account or using the Service, you agree to these Terms.
1. Definitions
Service — the Durex.media platform, including the web app, API, desktop app, and share viewer
User — any person with a registered account on the Service
Viewer — any person who accesses content via a share link (with or without an account)
Operator — the entity operating Durex.media
2. Accounts
Registration requires a valid email address
You are responsible for keeping your password and 2FA credentials secure
You may not create fake, automated or multiple accounts
Accounts are personal and non-transferable
You must be at least 16 years old to use the Service
3. Acceptable use
You may not upload, share or process content that:
Infringes the intellectual property rights of any third party
Contains malware, viruses or malicious code
Is illegal under applicable law in your jurisdiction
Is used to harass, threaten or harm other individuals
Violates the privacy of others
The Operator reserves the right to remove content and suspend accounts that violate these rules.
4. Share links
When you create a share link, you are responsible for who you share it with. You can set passwords, expiry dates, dynamic watermarks and download restrictions per link. Opening a share link logs the viewer's device type and timestamp — this is visible to the file owner. Business plan subscribers may apply white-label branding to share links (custom logo, brand name and accent color).
5. Storage and limits
Storage is allocated per plan:
Starter — 50 GB storage, up to 3 users
Pro — 250 GB storage, up to 10 users
Business — 1 TB storage, up to 25 users, white-label share branding
Custom — storage and user limits agreed individually with the Operator
Files exceeding your storage quota cannot be uploaded until you upgrade or free up space. The Operator may enforce file type restrictions to prevent abuse. Individual file uploads are capped at 5 GB.
6. Subscriptions and billing
Payments are processed by Stripe Inc. under their terms
The Starter plan includes a 14-day free trial; a valid payment method is required to start the trial and you may cancel at any time before it ends with no charge
Subscriptions renew automatically at the end of each billing period until cancelled
Annual plans are billed upfront with a 20% discount versus monthly
You can cancel at any time in Settings — access continues until the end of the paid period
14-day money-back guarantee — request a full refund within 14 days of your first purchase, no questions asked via our contact form. Renewals after the first period are non-refundable but you may cancel to stop future renewals.
Stripe processing fees (~2.9% + fixed fee) are not refunded by the payment processor and remain a cost to the Operator
Prices may change with 30 days notice to existing subscribers
6a. Referral program
Users with an active paid subscription can invite others via their unique referral link (durex.media/?ref=username)
Invited users receive 14 days of Pro plan free (new users) or +14 days added to an existing subscription when they first subscribe
Rewards for the referrer unlock after a 7-day hold period during which the invited user's subscription must remain active. Refunds, disputes, or cancellations within this window void the reward.
Reward tiers (cumulative, persistent): 3 successful referrals = +14 days of current plan (per each 3rd); 10 = 1 month free; 25 = 50% discount on the plan level active at the time of unlock, valid for as long as the subscription remains continuously active.
The -50% discount terminates if you downgrade to Free for 30+ consecutive days. Upgrading to a higher plan after unlocking the discount applies full pricing for the new plan.
Self-referrals, duplicate accounts, and fraudulent sign-ups (same payment fingerprint, IP abuse) are disqualified and may result in account suspension. Refunded/charged-back payments nullify rewards tied to them.
We reserve the right to adjust reward thresholds with 30-day notice. Already-unlocked rewards are grandfathered.
6b. Copyright and DMCA / EU notice-and-takedown
Durex.media operates as a neutral hosting provider. We respect copyright holders and comply with the DMCA (US 17 U.S.C. §512) and EU notice-and-takedown framework (EU Digital Services Act, EU Copyright Directive 2019/790).
User responsibility: You are solely responsible for the content you upload. By uploading, you represent that you own the rights or have authorization to share that content.
Reporting infringement: Rights holders may submit a takedown notice at durex.media/dmca or via our contact form. Notices must include: your identity, the work allegedly infringed, the infringing URL, a good-faith belief statement, and a statement under penalty of perjury that the information is accurate.
Response time: We review and act on valid notices within 24-72 hours. Content found to infringe is removed and the uploader notified.
Counter-notice: If your content was removed and you believe in error (you own the rights, fair use applies, etc.), you may submit a counter-notice within 14 days via our contact form. Upon valid counter-notice, we restore the content within 10-14 business days unless the claimant initiates legal action.
Repeat infringer policy: Accounts accumulating 3 valid copyright strikes are permanently terminated, including all uploaded content and active subscriptions. Strikes do not expire.
False claims: Submitting fraudulent takedown notices or counter-notices exposes you to liability under 17 U.S.C. §512(f) and applicable EU law.

7. Service availability
We aim for 99.5% uptime per calendar month. Scheduled maintenance will be announced in advance when possible. We are not liable for downtime caused by circumstances outside our control (force majeure, upstream provider failures, etc.).
8. Intellectual property
You retain full ownership of all files you upload. By uploading, you grant the Operator a limited license to store, display and transmit your content solely to provide the Service. The Service itself — its code, design, and branding — is owned by the Operator.
9. Limitation of liability
The Service is provided "as is." The Operator is not liable for: data loss due to user error or force majeure; content uploaded or shared by users; indirect or consequential damages. Our total liability to you does not exceed the amount paid in the 3 months preceding the claim.
10. Termination
You may delete your account at any time in Settings. The Operator may suspend or terminate accounts that violate these Terms, with notice where possible. Upon termination, your data is deleted per the Privacy Policy.
11. Changes to Terms
We will notify you of material changes by email or in-app notification at least 14 days before they take effect. Continued use of the Service constitutes acceptance.
12. Governing law
These Terms are governed by applicable law in the Operator's jurisdiction. Disputes will be resolved by the competent courts of that jurisdiction.
